The flash player is free to download and everyone can use it.
Just because people may not have it installed already ( or uninstalled it for reasons), doesn't mean it's not allowed ;)

If you're talking about Flash development: The Flex SDK (which is needed for Actionscript Development) is free and iirc open-source, the Creative Suite is fully available as a demo, so don't hesitate to use them!
